By accessing or using Essetly ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. These terms constitute a legally binding agreement between you and Essetly.
2. Description of Service
Essetly is a digital life organiser that allows you to store, manage and securely share your important financial documents, insurance policies, assets, liabilities and personal records with trusted family members or advisors.
3. Eligibility
You must be at least 18 years of age and a resident of Australia to use Essetly. By using the Service you represent that you meet these requirements.
4. Account Responsibilities
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Ensuring the accuracy of information you provide
- Notifying us immediately of any unauthorised access
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Upload malicious files or content
- Attempt to gain unauthorised access to other accounts
- Share access credentials with unauthorised persons
- Use the Service to store content that infringes third party rights

Essetly is an organisational tool and does not provide financial advice. The information displayed is for organisational purposes only. You should always consult a qualified financial advisor for financial decisions. Essetly is not responsible for any financial decisions made based on information stored in the platform.
7. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
8. Intellectual Property
The Essetly platform, including its design, features and content, is owned by Essetly and protected by Australian intellectual property laws. You retain ownership of all content you upload to the platform.
9. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates or experience outages. We will endeavour to provide advance notice of planned maintenance.
10. Limitation of Liability
To the maximum extent permitted by Australian law, Essetly shall not be liable for any indirect, incidental, special or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
11. Termination
You may terminate your account at any time by contacting us. We reserve the right to suspend or terminate accounts that violate these Terms. Upon termination, your data will be deleted within 30 days.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of significant changes by email or in-app notification. Continued use of the Service after changes constitutes acceptance of the new Terms.
13. Governing Law
These Terms are governed by the laws of South Australia, Australia. Any disputes shall be resolved in the courts of South Australia.
